TERMS AND CONDITIONS FOR MEMBERSHIP

Upper Waitematā Marine Centre (UWMC)

By becoming a member of the Upper Waitematā Marine Centre (UWMC), I agree to the following Terms and Conditions.

Role of UWMC

UWMC is owned and operated by the Hobsonville Point Marine Sports Recreation Centre Charitable Trust (HPMSRCCT).

UWMC operates as a landlord and facility provider. Licensed Organisations (such as Hobsonville Yacht Club, Westlake Boys High School Rowing Society and others) operate from the facility under lease or licence agreements.

UWMC does not organise, supervise, or manage water-based or sporting activities conducted by Licensed Organisations.

All marine and on-water operations are the responsibility of the relevant Licensed Organisation under their own Health and Safety policies and procedures.

UWMC social membership:

  • Supports the Centre and its development.

  • Provides access to UWMC communications and approved community events.

  • Does not grant membership, equipment access, training rights, or participation privileges within any Licensed Organisation.

Participation in club-run activities must be arranged directly with that club.

1. Scope of Application

These Terms apply to:

  • Social members

  • Visitors attending UWMC-hosted events

  • Users of shared areas within the UWMC facility

These Terms apply only to areas owned, leased or licensed by HPMSRCCT and do not extend to water-based activities or off-site launching facilities managed by Licensed Organisations.

2. Health and Safety Responsibilities

I acknowledge that under the Health and Safety at Work Act 2015, health and safety is a shared responsibility.

While at the UWMC facility, I agree to:

  • Take reasonable care for my own health and safety.

  • Ensure my actions do not adversely affect the health and safety of others.

  • Follow all safety signage, instructions, and reasonable directions from authorised personnel.

  • Participate in any required safety inductions relevant to my access.

  • Use equipment and facilities safely and as intended.

  • Use any required personal protective equipment appropriately.

  • Report hazards, accidents, injuries, or near misses immediately to a Health and Safety Coordinator or UWMC representative.

3. Hazard and Risk Management

I understand that UWMC operates a hazard and risk management system.
I agree to cooperate with UWMC in identifying and managing hazards and to immediately report any unsafe condition or behaviour.

I acknowledge that I have the responsibility to stop or raise concern about any activity I believe is unsafe.

4. Emergency Procedures

I agree to familiarise myself with emergency procedures displayed on site, including evacuation routes and emergency assembly points.

In the event of an emergency, I will follow the directions of authorised personnel or emergency services.

5. No Liability for Licensed Organisation Activities

I acknowledge that Licensed Organisations operating from UWMC are independent Person Conducting a Business or Undertaking (PCBU) under the Health and Safety at Work Act 2015.

UWMC is not responsible for:

  • On-water operations

  • Sporting activities

  • Training sessions

  • Equipment use managed by Licensed Organisations

  • Activities conducted off-site

Any participation in such activities is subject to the policies and waivers of the relevant Licensed Organisation.

6. Waiver of Liability (Facility Use)

To the extent permitted by law, I waive and release any claims against HPMSRCCT, its officers, trustees, committee members, volunteers, agents, and contractors for injury, loss, or damage arising from my use of the UWMC facility or attendance at UWMC-hosted events.

This clause does not limit rights under New Zealand law.

7. Indemnity

I agree to indemnify and hold harmless UWMC and its representatives from liability, loss, damage, or expense (including legal costs) arising from my negligent or unlawful actions while using the facility.

8. Damage to Property

I accept responsibility for any damage I cause to UWMC property or facilities due to negligence, misuse, or failure to follow reasonable instructions.

9. Alcohol and Behaviour

I agree to behave responsibly while on site and not attend the facility while under the influence of alcohol or drugs in a manner that may endanger myself or others, except within authorised licensed areas during approved events.

10. Personal Property

UWMC is not responsible for loss of or damage to personal property while on site.

11. Photography and Media

I consent to photographs or video being taken at UWMC-hosted events and used for promotional, reporting, or communication purposes unless I notify UWMC in writing.

12. Membership Fees

Membership and event fees are non-refundable and non-transferable unless required by law.

13. Privacy

UWMC collects and manages personal information in accordance with the New Zealand Privacy Act 2020 for membership and communication purposes.

14. Code of Conduct and Policies

I agree to comply with:

  • The UWMC Health and Safety Policy

  • The UWMC Code of Conduct

  • Any site-specific safety procedures

  • Reasonable instructions from authorised personnel

15. Participants Under 18

If the member is under 18 years of age, a parent or legal guardian must accept these Terms on their behalf and accepts responsibility for the minor’s conduct while on site.

16. Continuous Improvement and Review

I acknowledge that UWMC regularly reviews and improves its Health and Safety systems and may update policies accordingly.

17. Changes to Terms

UWMC may amend these Terms and Conditions at any time. Updates will be communicated via email or published on the UWMC website. Continued membership indicates acceptance of the updated Terms.

18. Compliance with New Zealand Law

Nothing in these Terms limits any rights under New Zealand law, including the Consumer Guarantees Act 1993 or the Health and Safety at Work Act 2015.

19. Electronic Agreement

By submitting my membership application form via TidyHQ, I confirm that I have read and understood these Terms and Conditions and agree to be legally bound by them.
